General Terms and Conditions

For the booking and implementation of package tours between Jinchin Queen Tours LLC (limited liability), Nalaikh District, 2ndKhoroo, 39-8, Ulaanbaatar - (email: jinchin.tours@gmail.com/ phone: +976-99020710) here in after ‘Jinchin Queen Tours’ or the ‘company’ and the booking party, the ‘traveler’, the following General Terms Conditions apply, provided that nothing else has been agreed.

 

1. Travel contract
1.1. The basis of the travel contract is the travel description, itinerary and additional information for the discussed trip sent by Jinchin Queen Toursprior to booking, provided you have this at the time of booking. Travel agents and service providers (e.g. hotels, transport companies) are not authorized to enter into agreements to amend the travel contract. As a tour operator, Jinchin Queen Tours is responsible for the provision of all services under the contract and has to provide assistance to the traveler in accordance if he/shefaces difficulties.
1.2. The traveler is responsible for all contractual obligations of travelers for whom the booking is made, as well as for his / her own, insofar as this obligation has been accepted by an express and separate declaration.
1.3. If the content of travel confirmation differs from the bookings, the company must notify the traveler at least two weeks in advance to explain the reasoning and change in tour price, if it should occur. 

2. Payment / travel documents
2.1 The company may receive payment from the customer or partners upon issuing of official invoice from the official company email. The tour confirmation requires a deposit of up to 30% per agreement with the concerned parties. 
2.2 Full payment of tours is due 14 days before the start of the journey.
2.3 Upon discussion with the company, a cash payment of up to 40% of total tour payment may be made upon arrival in the country. 
2.4 If the traveler does not make down payment and / or the final payment according to the agreed payment due dates, there is no legal or contractual right of retention on the traveler’s side, then the company holds the right to withdraw from the travel contract after a reminder with a deadline and to charge you with withdrawal costs in accordance with signed agreements.

3. Changes to services before the start of the tour
3.1 If deviations from the original agreed itinerary become essential for high quality execution of the tour, the company must notify the guests and/or partners in timely manner and provide full details. 
3.2. Jinchin Queen Toursis to inform the booking party about changes in service immediately after becoming aware of the needtointroduce updates (via e-mail, SMS or voice message) in a clear and understandable manner.
3.4. In cases of introduced changes, if the companymanages to lower costs during the implementing ofupdates to the trip,the guests are to be reimbursed the difference.

4. Cancellation by the customer before the start of the journey / cancellation costs
4.1 If the traveler decides to cancel the trip in advance, the company must be notified via the company email. 
4.2Jinchin Queen Tours cannot claim any compensation if unavoidable, extraordinary circumstances occur at or in the immediate vicinity that significantly affect the implementation of the package tour or the transport of people to the destination. Circumstances are unavoidable and extraordinary in the sense of this subtitle if they are not subject to the control of the party who invokes them and their consequences could not have been avoided even if all reasonable precautions had been taken. In these cases, both Jinchin Queen Tours and the traveler are entitled to withdraw. Jinchin Queen Tours will make payments on the tour price within 14 days of the cancellation.

5. Unused service
If the traveler does not make use of travel services that the company was willing and able to provide in accordance with the contract for reasons that are attributed to the traveler, the traveler is not entitled to a proportionate reimbursement of the travel price. This does not apply if such reasons would have permitted a withdrawal from the contract free of charge or to terminate the travel contract according to the provisions. 

6. Termination for behavioral reasons
Jinchin Queen Tours can withdraw from the travel contract or terminate the travel contract without notice after the start of the journey if the traveler disrupts the implementation of the journey, regardless of our warning, or behaves contrary to the contract to such an extent that immediate cancellation of the contract is justified. This does not apply if the behavior contrary to the contract is caused by a violation of our own information obligations. If Jinchin Queen Tours terminates the contract, the company retains right to travel price; however, the company will be obliged to refund saved expenses that occur.

7. Travel protection (travel cancellation insurance, etc.)
The company would like to point out that in some cases of withdrawal (e.g. unexpected illness before departure) you can take out cancellation insurance and travel interruption insurance. We also strongly recommend that you acquire insurance to cover the costs of assistance including repatriation in the event of an accident, illness or death. Jinchin Queen Tours has its liability insurance and local traveler’s insurance for emergencies. 

8. Data protection
When booking is confirmed, the company does collect personal data that is necessary for the fulfillment and execution of the travel contract. These data are electronically stored, processed and - if necessary for the purpose of the contract - transmitted to third parties, e.g. service providers such as hotels and airlines. 

9.Cancelation fees 
The company maintains following standard cancelation fees for its confirmed bookings:  

- Free cancelation 50 days before the start of services
- 40 days before the start of the services 10%
- 30 days before the start of the services 40%
- 15 days before the start of the services 50%
- 10 days before the start of the services 60%
- 7 days before the start of the services 80%

However, if the local service providers are able to provide cancelation with reduced fees, the company will also provide the acquired difference to the travelers.
